By accessing or using the website located at ardenarcademasonry.com ("the Site") or by engaging Arden-Arcade Concrete & Masonry ("we," "us," or "our") to perform masonry or concrete services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Site or engage our services.
Arden-Arcade Concrete & Masonry is a state-licensed masonry contractor providing residential and commercial masonry, concrete, and related services in Arden-Arcade, CA and the surrounding Sacramento area. Our services include, but are not limited to, foundation repair, chimney repair, tuckpointing, brick repair, retaining walls, driveway pavers, and other masonry work.
Information on the Site describes our services in general terms. The scope, timeline, and price of any specific project will be governed by the written estimate or contract provided to you before work begins. In the event of a conflict between the Site and a written project agreement, the written agreement controls.
Estimates provided verbally or through our website contact form are preliminary and non-binding. A binding price quote will be provided in writing after an in-person assessment of your property.
Final pricing may differ from a preliminary estimate if site conditions discovered during work - such as additional structural damage, unforeseen soil conditions, or permit requirements - materially change the scope of the project. We will notify you of any changes and obtain your written approval before proceeding with work beyond the original agreed scope.
We reserve the right to adjust our pricing at any time. Changes will not affect projects where a written agreement has already been signed.
Project start dates are scheduled in good faith and may be affected by weather, permit timelines, material availability, or other factors outside our control. We will notify you promptly if a scheduled date needs to change and will work with you to reschedule.
If you need to cancel or reschedule a confirmed project, please contact us as soon as possible at (916) 270-0260 or support@ardenarcademasonry.com. Cancellation terms for any deposit or materials already purchased will be outlined in your written project agreement.
We reserve the right to decline or discontinue a project if site conditions are unsafe, if the scope of work changes substantially from what was agreed, or if payment obligations are not met.
Payment terms will be specified in your written project agreement. In general, a deposit may be required before work begins, with the remaining balance due upon completion.
If payment is not received according to the agreed schedule, we reserve the right to suspend work until the account is brought current. Accounts more than 30 days past due may be subject to a late fee as specified in the written agreement, and we reserve the right to pursue collection through all lawful means, including placing a mechanic's lien on the property in accordance with California law.
Acceptable payment methods will be listed in your project agreement. We do not accept payment arrangements that are not specified in writing.
Where a building permit is required for the work performed, we will obtain the permit on your behalf as part of our project scope. You are responsible for ensuring that our crew has lawful access to the property and that no other permits, homeowner association approvals, or third-party consents are required beyond what we have agreed to obtain. If you have any outstanding violations or liens on your property that could affect permitting, please disclose these to us before work begins.
Any warranty for workmanship or materials will be stated in your written project agreement. If no warranty is specified, work is provided as-is.
Warranties do not cover damage caused by events outside our control, including but not limited to: earthquakes, flooding, acts of nature, soil movement beyond what was addressed in the repair, unauthorized modifications made by others after completion, or failure to maintain the repaired area in a reasonable manner.
The information on the Site is provided for general informational purposes only. We make no warranty, express or implied, that the Site is free of errors or that any general information applies to your specific property or situation.
To the fullest extent permitted by law, Arden-Arcade Concrete & Masonry shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Site or from services provided, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of services rendered shall not exceed the total amount you paid us for the specific project to which the claim relates. Some states do not allow the exclusion or limitation of certain damages, so the above limitation may not apply to you.
We hope to resolve any dispute informally. If you have a concern, please contact us first at support@ardenarcademasonry.com or (916) 270-0260. We will make a good-faith effort to address any legitimate concern within a reasonable time.
If a dispute cannot be resolved informally, both parties agree to submit to binding arbitration in Sacramento County, California, before a mutually agreed-upon arbitrator, unless the claim qualifies for small claims court. Each party will bear its own legal costs unless the arbitrator determines otherwise.
These Terms and Conditions are governed by the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings not resolved through arbitration shall be brought exclusively in the courts of Sacramento County, California.
You may use the Site for lawful purposes only. You agree not to use the Site to submit false or misleading information, to attempt to gain unauthorized access to any part of the Site, or to engage in any conduct that could damage, disable, or overburden the Site.
All content on the Site - including text, images, and the Arden-Arcade Concrete & Masonry name and logo - is the property of Arden-Arcade Concrete & Masonry and may not be copied, reproduced, or used without our written permission.
We may update these Terms and Conditions at any time. When we do, we will update the effective date at the top of this page. Your continued use of the Site after changes are posted means you accept the updated terms. We encourage you to review this page occasionally.
